GENERAL TERMS AND CONDITIONS



Placing an order
When placing an order with us you will have read, understood and agreed to these Terms and Conditions. If you are unsure or unclear about any aspect of these terms, please contact us before placing an order with us either by email customerservice@silkroadboutique.com. All our calls may be recorded for training and monitoring purposes.
By placing an order with us you are agreeing to purchase the goods detailed in your order upon the terms and conditions described in your order. You warrant that:

  • You are legally capable of entering into binding contracts; and
  • You are 18 years or over in age;

After placing an order we will send you a confirmation e-mail that your order has been received but this is not a confirmation that your order to purchase the goods has been accepted. All orders are subject to approval by us (Silk Road Boutique Limited), and we will confirm the sale of our products once an order has been accepted, processed and dispatched to you. Your credit card or debit card account will only be authorised once the order has been dispatched. This does not affect your statutory rights. Prices and stock availability of goods are subject to change without notice. Please note a delivery charge will be added to your order value where appropriate and a valid signature is required when the order has been sent to you. Please see our Delivery for details.
All dates quoted on the Delivery page are estimated delivery dates only and may be subject to change. We can accept no liability for any loss or damage (whether direct or indirect) if delivery takes place at any time other than the estimated date for delivery.


Stock availability
At all times we will display through this website all items in our current range and aim to hold stock of all styles and sizes while the product is active. However, there are times an item will be out of stock and if this is the case then this will be highlighted in your shopping basket. If there is a reason to contact you in regards to stack availability then we will do so.


Consistency of goods
Care is taken to ensure the description and specifications of all our products are correct. While the colour reproduction of the products is a close representation, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used to view the products.


Cancelling an order
Under the Consumer Protection Distance Selling Regulation you are entitled to cancel you order within seven working days after the day on which you receive the products. This is subject to conforming to our Returns/refunds policy.
If you wish to implement your rights to cancel the contract after your order has already been dispatched please follow the process set out in our Returns page.
You will then need to return the item(s) you ordered from us. Parcels returned by post are sent at your own cost.


Gift services
We believe our luxurious silk garments deserve to be gorgeously gift wrapped. Therefore we offer complimentary gift wrap services for your purchases. When you place an order with us we will wrap your items beautifully and depending on the size of the items, we will place them in our special gift boxes or gift bags. We can deliver your purchase directly to the gift recipient at your instruction.

Returns/refunds policy
If you wish to return an item to us in the circumstances permitted by this agreement, we will examine the returned item and will notify you of your refund via e-mail within a reasonable period of time. We will usually refund any money received from you using the same method originally used by you to pay for your purchase. Return of an item is at your own cost. We cannot accept an item returned as faulty if the appropriate product care instructions have not been followed and the damage caused to the product is clearly due to wear and tear or misuse. We will process the refund due to you as soon as possible and, in any case, within 30 days of the day we received your cancellation or the day we confirmed to you via e-mail that you were entitled to a refund after we received and examined your returned item.

Items returned by you because of a defect will be refunded in full, including a refund of the delivery charge for sending the item to you. Or we can replace a same item for you at your request and post it to you free of charge after we received and examined your returned item. For further details please read our Returns page.


Prices
The prices quoted on this website are accurate at the time of publication, are quoted in pounds sterling and where appropriate are inclusive of UK tax (VAT) at the current rate. The price excludes delivery costs, which will be added to the total amount due. We will endeavour to deliver all purchases within five (5) days and in any event we will deliver purchases within thirty (30) days from the time the contract between us is made.
If your order is being dispatched to a destination outside the European Union (EU) then your sales tax will be zero. If your order is being sent to a member state of the EU then the selling price will include VAT.

You will be responsible for the payment of any customs or import duties levied once the package is delivery to destination country.
Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.
Our site contains a large number of products and it is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. If a product´s correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before dispatching the product, or reject your order and notify you of such rejection.

We are under no obligation to provide the product to you at the incorrect (lower) price, even after we have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mis-pricing.

We will not charge your credit or debit card until we dispatch your order. Payment for all products must be paid by credit or debit card. We accept payment with the cards identified on the order page.


Disclaimer, risks and limitations of liability
Silk Road Boutique does not exclude or limit liability for death or personal injury arising from its negligence or that of its members, for any fraudulent misrepresentation. Silk Road Boutique nor any associated company shall be liable; to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence for any indirect special or consequential loss or damage, costs, expenses or other claims for compensation whatsoever which arise out of or in connection with the use of this website, the supply of the products or their use or resale by you.

We accept no liability for any loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, waste of management or office time or for any indirect or consequential loss or damage of any kind however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

The products will be at your risk from the time of delivery. Ownership of the products will only pass to you when we receive full payment of all sums due in respect of the products, including delivery charges. We warrant to you that any product purchased from us through our site is of satisfactory quality. Our liability in connection with any product purchased through our site is strictly limited to the purchase price of that product. This does not include or limit in any way our liability:

  • For death or personal injury caused by our negligence;
  • Under section 2(3) of the Consumer Protection Act 1987;
  • For fraud or fraudulent misrepresentation; or
  • For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

Where you buy any product from a third party seller through our site, the seller's individual liability will be set out in the seller's terms and conditions.

Silk Road Boutique uses reasonable actions to ensure that the information on this website is accurate and up to date, it does not give any guarantee as to its accuracy or completeness will not be responsible for any errors or omissions or for the results arising from the use of such information. All steps are taken to ensure a fast and reliable service is provided, it does not guarantee that your use of this website will be interruption or error free and will not be responsible for any disruption, loss of or corruption of any material in transit, or loss of or corruption of material or data when downloaded onto any computer system.

Silk Road Boutique will also not be liable for your use of any other websites which you may access via links within this website. These links are provided merely as a service to users of this website and their inclusion in this website does not constitute an endorsement by or affiliation with Silk Road Boutique Limited.

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control (Force Majeure Event).
A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

  • Strikes, lock-outs or other industrial action.
  • Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.
  • Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
  • Impossibility of the use of public or private telecommunications networks.
  • The acts, decrees, legislation, regulations or restrictions of any government.

Our performance under any contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the contract may be performed despite the Force Majeure Event

Silk Road Boutique Limited will not be liable to you or deemed to be in breach of these terms and conditions or any other contract with you by reason of any delay in performing, or any failure to perform, any of its obligations in relation to the products ordered by you if the delay or failure was due to any cause beyond its reasonable control.
